I think it might contravene the terms of my ASBO to respond here.

You won't get my professional insight on this here, but I may give a bush lawyers analysis after I've had a chance to compare the two claims.

I have read the NZCSC statement of claim some time ago and I have briefly skimmed the NIWA statement of defence.

My first reaction to the former was "Load-a crap! What a joke. This'll be good." and my first reaction to the latter is, "Fair enough. Not all that surprised."

What is perhaps surprising is that they responded at all. Courts of Law are not the place to decide matters of science. Actually, I think that is probably the subtext of NIWA's response. I haven't read it closely enough to be sure.

(1) Maybe not, but courts of law are a place to sort out law breakers / criminals. There would be no court if there was not a 'case to answer' - decided by the judge(s) at deposition.

(2) Although, it is a great place to expose matters.

Yes, you are absolutely correct, especially your point 1.

Not so much with your second point, unless of course there is some criminality going on, or about some civil issue, but it has to relate to some precedent in another case and always based in actual law.
